The Federal High Court sitting in Lagos today refused an exparte application filed by Arik Air Receiver- Manager, Mr Kamilu Omokide to restrain the airline founder, Mr Arumemi Johnson – Ikhide from cooperating with an ongoing investigation being carried out by the Economic and Financial Crimes Commission (EFCC) into the receivership of his company by the Asset Management Corporation of Nigeria (AMCON).
Mr Omokide’s motion exparte for interim injunction in suit no FHC/C/LS/145/122 filed today at the Federal High court in Lagos by 2:30pm by the applicant brought against Arumemi aims to restrain the defendant or his agents from demanding from Arik employees operational documents relating to the management of Arik as well as demanding confidential operational documents without due authorization of the applicant.
The application read, ”On 08.06.2023, ostensibly while investigating the Petition, officers of the Economic and Financial Crimes Commission (EFCC) entered the premises of Arik in Ikeja, Lagos, along with the Respondent.
“Having gained entry alongside the officers of the EFCC on the date referred to above, the Respondent took it upon himself to interfere in the Applicant’s management of Arik, disrupt Arik’s business, and hinder employees in the performance of their duties, by: Threatening Arik employees and alleging that they were disloyal to him for supporting the receivership;
“Demanding and obtaining from Ark employees operational documents relating to the management of Arik; Taking pictures of confidential operational documents without due authorization of the Applicant;
Verbally assaulting and intimidating Arik employees, thus preventing them from discharging their official duties. Accessing Arik aircraft hangars without due authorization of the Applicant.”
However, in the ruling, the court asked Mr. Omokide to put the defendant on Notice.
Recall that on 11 April, 2023, Receiver Manager, Kamilu Alaba Omokhide issued an order to deny Chairman/Founder of the airline, Sir Johnson Arumemi Ikhide unfettered access to the company, Arik Air Limited despite a Court ruling that stated that the appointment of a Receiver Manager did not nullify all previously established organs of Arik Air such as boards and shareholders.
After the incident at Arik Headquarters, Arumemi-ikhide left the premises and proceeded to the MMA Domestic Airport Division of the Nigeria Police Force where he filed a statement.
